EU Consumer Rights - Right of Withdrawal

Your Right to Cancel

As a consumer purchasing from stockclear.eu, you have the legal right to cancel your order and return products within 14 days of receiving your goods, without providing any reason (cooling-off period). This right applies to all online purchases in accordance with EU Consumer Rights Directive 2011/83/EU.

Withdrawal Period

  • For goods: 14 days from the date you (or someone nominated by you) receive the goods
  • For services: 14 days from the date the contract was concluded
  • If the withdrawal period expires on a non-working day, your deadline is extended until the next working day

How to Exercise Your Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision by sending a clear statement to:

You may use the withdrawal form template below, but this is not mandatory:

"I hereby give notice that I cancel my contract of sale for the following goods: [product details], ordered on [date], received on [date]. Consumer name: [name], Consumer address: [address], Consumer signature: [signature], Date: [date]"

Returning the Goods

If you decide to return products within the 14-day withdrawal period:

  • You must return the goods within 14 days of informing us about your withdrawal
  • You are responsible for the direct costs of returning the goods unless we offer to collect them
  • Products must be returned in their original condition, with all accessories, packaging, and documentation
  • You may examine the goods in the same way you would in a physical store
  • You will be liable for any diminished value of goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning

Refund Process

Refund Timeline

We will refund the full purchase price, including original shipping costs (except additional costs if you chose a more expensive shipping method than our standard option), within 14 days of:

  • Receiving your withdrawal notice, or
  • Receiving the returned goods, or
  • Receiving proof of return dispatch

Refund Method

Refunds will be processed using the same payment method you used for the original purchase, unless you expressly agree otherwise. You will not incur any fees as a result of the refund.

Delayed Refunds

We may withhold the refund until we have received the returned goods or until you have provided evidence of return dispatch, whichever is earliest.

Products Exempt from Right of Withdrawal

In accordance with EU law, the following products cannot be returned under the 14-day withdrawal right:

  • Products made to order or clearly personalized/customized
  • Perishable goods or goods with short expiration dates
  • Sealed goods that have been opened and cannot be returned for health or hygiene reasons
  • Goods that deteriorate or expire rapidly
  • Digital content (downloads, streaming) where performance has begun with your prior express consent and acknowledgment that you lose your withdrawal right

Defective or Non-Conforming Products - Legal Guarantee

Two-Year Legal Guarantee

All products sold by stockclear.eu come with a minimum 2-year legal guarantee from the date of delivery, protecting you against:

  • Defective products
  • Products that don't match their description
  • Products that don't function as advertised

Your Rights for Defective Products

If a product is defective or non-conforming within the 2-year guarantee period, you can request:

  1. First: Repair or replacement (free of charge)
  2. If repair/replacement is impossible or fails: Price reduction or full refund

Claiming Under the Legal Guarantee

To claim under the legal guarantee:

  • Contact our customer service within a reasonable time of discovering the defect
  • Provide proof of purchase (order confirmation, invoice)
  • Describe the defect or non-conformity

We will cover all costs related to repair, replacement, or return shipping for defective products.

Commercial Warranties

Any additional commercial warranties or guarantees offered by manufacturers are separate from and in addition to your legal rights under EU consumer protection law. These additional warranties cannot reduce your statutory rights.
